As the year wraps up Upper Saddle River mayor and council are holding their ‘End of Year Meeting’ at 4pm today (December 30, 2019). Agenda here. It appears mostly about shuffling money around (“transfer of appropriations”) and bonds, so if fiduciary issues are your thing it might be of interest and worth your time. It’s your tax dollars.
On another note it appears that Toll Brothers had got themselves a lawsuit over infringement of a patent in soil remediation. CBA Environmental Services sued Toll Brothers..
alleged that Toll Brothers and three companies it hired willfully infringed its patent to remediate the site of a New Jersey housing development.
Ultimately it was thrown out as there wasn’t enough evidence that Toll Brothers controlled sufficient parts of the remediation to bear any responsibility. Phew. Which raises the ongoing question, was it actually done properly? Despite the Upper Saddle River Borough Engineer, Boswell Engineering, manipulating numbers and language to assure residents there are still significant doubts about the integrity and safety of the soil at the site.
You would think that with all the lingering doubts swirling about Orchard Ridge Preserve Toll Brothers would want to put this to rest and calm concerns. Maybe conduct random testing, with selected observers – residents, independent environmentalist and council members – and carry out fresh tests, while fully observed with new results that real witnesses can verify and testify to? But no, they have maintained a thorough position of silence throughout the entire fiasco. No statements, no website, no phone numbers. Nothing. And so, the whispering continues.
